1. Acceptance of the Agreement

By accessing or utilizing Reclaim-Yours.com (the "Service"), you agree to be legally bound by these Terms of Service ("Terms"). The Service is owned and operated by Reclaim-Yours ("Reclaim-Yours," "we," "us," or "our").

If you do not agree to these Terms, you are prohibited from using the Service. We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting with an updated "Last Updated" date. Your continued use of the platform signifies your acceptance of any revisions.

2. User Eligibility and Registration

To use this Service, you must be a resident of the United States and at least 18 years of age. You agree to provide truthful, current, and complete information during the registration process. You are solely responsible for safeguarding your account credentials and for all activities performed under your account.

3. Service Scope; No Professional Advice

Reclaim-Yours is a consumer advocacy software platform designed to help users organize subscriptions and draft documents for cancellations or disputes.

We are not a law firm, financial institution, credit repair organization, or government agency.

No Advice: We do not provide legal, tax, or financial advice. Use of the Service does not establish an attorney-client or fiduciary relationship.

4. AI Features and Data Processing

The Service utilizes automated tools and Artificial Intelligence to analyze information you provide (such as financial statements or emails) to identify recurring charges and assist in document preparation.

Authorization: You authorize Reclaim-Yours to scan your submitted content strictly to provide the Service.

User Verification: You are responsible for reviewing and verifying the accuracy of any AI-generated content before it is used or submitted to third parties.

5. Third-Party and Merchant Interactions

Reclaim-Yours facilitates navigation through merchant policies but is not affiliated with, endorsed by, or partnered with any third-party banks or service providers. You are exclusively responsible for your interactions with these entities and any results thereof.

6. Information Accuracy and Account Linking

You represent that:

You own or have legal authorization for any accounts you link to the Service.
All uploaded data is authentic and accurate.

Fraudulent Activity: Submitting false or misleading information is a material breach of these Terms and may lead to account termination.

7. Subscription, Trials, and Billing

Monthly Subscription	$18.90	Charged automatically after the 7-day trial ends.

Automatic Renewal: Unless you cancel before the end of your 7-day trial, you will be automatically enrolled in a monthly subscription. You authorize Reclaim-Yours to charge $18.90 to your payment method on file every month until you cancel.

8. Cancellation Policy

Cancel Anytime: You may terminate your subscription at any time to prevent future billing.

Effect: Cancellation stops future charges but does not automatically trigger a refund for payments already processed.

9. Refunds and Billing Discrepancies

Errors: If you identify a billing error, contact us at [email protected] or 1-800-934-4957. Validated errors will be refunded to the original payment method.

Policy: Outside of billing errors or legal requirements, all fees (including the Activation Fee and subsequent subscription fees) are non-refundable.

10. Payment Authorization

By providing your payment details, you authorize Reclaim-Yours to process the initial $3.00 fee and the recurring $18.90 monthly fees. If paying via ACH, you authorize electronic debits from your designated bank account.

11. Communications

Electronic: You consent to receive account-related notices and updates electronically.

SMS: By providing a mobile number, you consent to receive SMS alerts. Standard data rates apply. Text STOP to opt out or HELP for assistance.

12. Intellectual Property

All software, AI prompts, workflows, and branding on the Service are the exclusive property of Reclaim-Yours. You are granted a limited, revocable license for personal, non-commercial use only.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS." RECLAIM-YOURS DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT OF THE LAW. WE DO NOT GUARANTEE SUCCESSFUL REFUNDS, FINANCIAL RECOVERY, OR SPECIFIC OUTCOMES.

15. Limitation of Liability

To the maximum extent permitted by law, Reclaim-Yours' total liability is limited to the amount you paid to us during the three (3) months prior to the claim. We are not liable for indirect, incidental, or punitive damages.

16. Indemnification

You agree to defend and hold Reclaim-Yours harmless against any claims, losses, or expenses resulting from your misuse of the Service or violation of these Terms.

17. Dispute Resolution (Arbitration & Class Action Waiver)

Informal Resolution: You agree to attempt to resolve any dispute by emailing [email protected] before seeking arbitration.

Binding Arbitration: Unresolved disputes will be settled by individual binding arbitration under the American Arbitration Association (AAA) Consumer Rules.

Venue: Arbitration will occur in Santa Barbara County, California, or via remote video link.

Class Action Waiver: You agree to bring claims only as an individual, not as a plaintiff or class member in any purported class or representative proceeding.

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
